Legal fees can be intimidating, especially if you have no idea what will be charged. We are happy to discuss fees and disbursements with you at any time.

Fees and Disbursements

We offer an initial half hour consultation without obligation. If at the end of that time you decide not to retain us, or we cannot provide the service you require there is no charge.

Disbursements are charged in addition to fees. Fees are the money we receive for our services. Disbursements are costs incurred or monies paid to third parties directly for your benefit. These include items such as court filing fees, registration fees, fees charged by government organizations for providing information or services, courier fees, and office expenses where they are significant. We do not mark up our disbursements and provide you with invoices from the third party suppliers or service providers.

In some cases it is possible for us to quote a ‘block fee’ for the completion of a service. Matters such as residential purchases and sales or preparation of wills are generally handled as block fee matters. Disbursements can usually be estimated fairly accurately in such cases.

In many situations, however, it is not possible to know in advance how much work will be involved. In these cases, we charge an hourly rate for lawyers’ time. Our current general rate is $260.00 per hour. We generally do not charge separately for staff time and will not do so without discussing the matter with you.

The timing of payment will depend on the nature of your case. If a substantial commitment is involved we may require a ‘retainer’ at the start of a case or at various times throughout. The retainer is kept in trust and applied to pay fees and disbursements as they come due. In some situations, terms for payment can be arranged.

We are required to charge GST on our fees and some of our disbursements. We accept payment by cheque, VISA, Interac, and cash up to certain limits.

Ontario Land Transfer Tax Calculation

A reduction of a maximum of $4,000 is available for those who qualify for the First Time Home Buyer Tax Credit.

The formula to determine your Land Transfer Tax is as follows and is based on the purchase price on your Agreement of Purchase and Sale in the following rates by increments:

  • For the first $55,000 of the purchase price the rate is 0.5%.
  • The amount of the purchase price exceeding $55,000 up to and including $250,000: 1.0%.
  • The amount of the purchase price exceeding $250,000 up to and including $400,000: 1.5%.
  • The amount of the purchase price exceeding $400,000: 2.0%.
  • Any purchase price that exceeds $2,000,000 where the land contains one or two single family residences: 2.5%.
